Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the dontab.com website  (the “Platform”), operated by dontab  (“dontab,” “we,” “us,” or “our”), a company registered in Ajman, United Arab Emirates, with its office at Ajman ANC Free Zone, Ajman, UAE. By accessing or using the Platform, you (“User,” “you”) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease using the Platform.

These Terms apply to all users, including individuals, businesses, and entities accessing the Platform for personal or commercial purposes. Additional agreements, such as an Advertising Agreement for business advertisers, may apply in conjunction with these Terms.

1. Definitions

Unless the context requires otherwise, the following terms have the meanings below:

  • Advertising Agreement: A separate contract for advertising services between dontab and a Client.
  • Ad Services Package: A bundle of advertising products or services provided to a Client, as specified in an order form.
  • Client: An entity entering into an Advertising Agreement with dontab.
  • Content: All material, information, listings, or data published on or available via the Platform.
  • Intellectual Property Rights: All intellectual property rights, including patents, trademarks, copyrights, database rights, trade secrets, and similar rights, whether registered or unregistered, worldwide.
  • Listing: An advertisement for an item, service, property, job, or motor posted by a User on the Platform.
  • Paid Service: Features or services on the Platform requiring payment, such as Featured Ads.
  • Posting Agent: A third-party service or intermediary posting Content on behalf of others.
  • Privacy Policy: dontab’s policy governing the collection, use, and protection of personal data, available at [insert link].
  • Registration Details: Information provided by a User during account creation (e.g., name, email, phone number).
  • Unacceptable Content: Any Content that is illegal, offensive, defamatory, misleading, infringing, or otherwise prohibited under UAE law or these Terms, including material that is obscene, racist, harmful, or invasive of privacy.
  • User Content: Content uploaded or posted by a User on the Platform.

2. General Terms for All Users

2.1. Eligibility: You must be at least 18 years old and legally capable of entering contracts to use the Platform. By using the Platform, you warrant that you meet these requirements.

2.2. Account Creation and Responsibility:

  • To access certain features, you must create an account with accurate, current, and complete Registration Details.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Notify us immediately at support@dontab.com of any unauthorized use or security breach.
  • You may request account deletion by emailing support@dontab.com.

2.3. Acceptable Use:

  • You must use the Platform lawfully and in accordance with these Terms.
  • Prohibited actions include:
    • Uploading or sharing Unacceptable Content.
    • Interfering with the Platform’s functionality (e.g., introducing viruses, hacking, or using automated tools like spiders or bots without permission).
    • Impersonating others or misrepresenting affiliations.
    • Harassing, stalking, or contacting Users who have opted out of communication.
    • Collecting personal data for unlawful or commercial purposes without consent.
    • Posting spam, pyramid schemes, or unsolicited commercial advertisements.
  • You warrant that any User Content you post complies with our Acceptable Use Policy (Section 11).

2.4. User Content License:

  • By posting User Content, you grant dontab a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, display, and promote such Content in connection with the Platform.
  • You warrant that you have all necessary rights to grant this license and that your Content is not Unacceptable.
  • dontab may remove or edit User Content at its sole discretion without notice.

2.5. Platform License:

  • Subject to these Terms, dontab grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal or permitted commercial purposes.
  • This license does not permit:
    • Use by Posting Agents without express written consent.
    • Data scraping, copying, or derivative use of the Platform or Content for unauthorized purposes.
    • Commercial use beyond what is expressly allowed.

2.6. Third-Party Content:

  • The Platform may contain advertisements or links to third-party websites or services. dontab is not responsible for the accuracy, legality, or safety of such content or services.
  • Linking to third-party sites is at your own risk, and dontab disclaims all liability related thereto.

2.7. Suspension or Termination:

  • dontab may suspend or terminate your account or access to the Platform if you breach these Terms or for any other reason deemed appropriate, at our sole discretion.
  • You will be notified by email, and you must not attempt to re-register directly or indirectly.
  • Termination does not affect accrued rights or liabilities.

2.8. Updates to Terms:

  • We may update these Terms at any time. The current version is available on the Platform, with the Effective Date noted above.
  • Check the Terms before each use. Continued use after changes constitutes acceptance of the updated Terms. If you do not agree, stop using the Platform.

3. Listings and Paid Services

3.1. General Listing Rules:

  • Sellers must:
    • Be legally permitted to sell or provide the listed item or service.
    • Own or have legal rights to sell the item or service.
    • Provide accurate, complete descriptions in Listings.
    • Post only one item or service per Listing.
    • Use appropriate categories and comply with all applicable laws.
    • Not post counterfeit or infringing items.
  • Buyers must act lawfully and in good faith.
  • dontab is not responsible for Listings or transactions between Users but may remove Listings that violate these Terms.

3.2. Paid Services:

  • Paid Services, such as Featured Ads, may be offered to enhance Listing visibility.
  • Fees for Paid Services are non-refundable, even if a Listing is removed for violating these Terms or fails to achieve desired results.
  • Payments are processed via third-party providers (e.g., Click & Buy), subject to their terms. dontab is not liable for issues arising from third-party payment services.
  • You authorize dontab to charge your provided payment method for Paid Services.

3.3. AI-Assisted Listings (New):

  • dontab may offer an AI tool to assist in creating Listings. This feature is provided for convenience only.
  • You are responsible for verifying the accuracy and completeness of AI-generated Listings before publication.
  • dontab excludes all liability for errors or omissions in AI-assisted Listings.

4. Category-Specific Terms

4.1. Property for Sale and Rent

  • All Advertisers:
    • Listings must be for properties currently available and lawfully sellable or leasable.
    • Advertisements must not contain defamatory, misleading, or unlawful content, including promotions of illegal occupancy or activities.
    • dontab does not verify Listing details and is not a real estate broker. Users must conduct their own due diligence.
  • Brokers:
    • Must hold a valid Real Estate Regulatory Authority (RERA) license or equivalent in the relevant Emirate.
    • Off-plan projects must be RERA-registered.
    • Subleasing requires a DED and RERA license for “Leasing and Management of Other People’s Property.”
    • Short-term or holiday home leasing requires a Dubai Tourism and Commerce Marketing (DTCM) license.
    • Advertisements must display RERA Permit Number, Office Registration Number, and Broker Registration Number.
  • Developers:
    • Must hold a valid RERA license and, for off-plan projects, a RERA-approved Escrow Account.
    • Advertisements must display the RERA Permit Number.
  • Owners/Landlords:
    • Must hold a valid RERA license or equivalent.
    • Short-term leasing requires a DTCM license.
  • Tenants:
    • Must have written landlord consent to advertise a property.
  • Call Recording (New):
    • Calls to RERA-licensed brokers via uniquely assigned numbers may be recorded for quality and training purposes. By using the Platform, you consent to such recordings without further notice.

4.2. Vehicles

  • Sellers must ensure that any vehicles (car, motorcycle, bus, boats, etc.) is:
    • Roadworthy and located in the UAE (or cleared by UAE customs).
    • Legally owned by the seller or their principal.
    • Immediately available for sale with accurate pricing and descriptions.
  • dontab may request proof of ownership or location within 24 hours. Failure to provide proof may result in Listing removal without refund.

4.3. Jobs

  • Employers/Recruiters:
    • dontab is not responsible for job seeker information or CV accuracy. The CV Search feature is a tool, not a guarantee of candidate suitability.
    • Fees for job Listings or CV Search are non-refundable.
  • Job Seekers:
    • Posting a job-seeking ad grants employers/recruiters access to your CV and personal details.
    • Fees are non-refundable, even if no job is secured.
  • Job Ad Restrictions (New):
    • Ads listing multiple positions in a single post will be removed after 24 hours unless edited to feature one position. No refunds will be issued.

5. Intellectual Property

5.1. dontab’s Rights:

  • dontab owns or licenses all Intellectual Property Rights in the Platform and Content, including designs, text, graphics, and trademarks.
  • You may print or download one copy of Platform pages for personal use, provided you do not modify or use Content commercially without permission.

5.2. User Content:

  • You retain ownership of your User Content but grant dontab the license described in Section 2.4.
  • You must not post Content that infringes third-party Intellectual Property Rights.

5.3. Infringement Reporting:

  • If you believe Content infringes your Intellectual Property Rights, notify us at support@dontab.com with:
    • A signed statement identifying the infringed rights and Content.
    • Your contact details and authorization to act.
    • A good-faith belief that the use is unauthorized.
    • A statement holding dontab harmless from third-party claims.
  • dontab will investigate and may remove infringing Content promptly.

6. Privacy and Data Use

6.1. Data Collection:

  • We collect and process personal data as outlined in our Privacy Policy.
  • Registration Details and usage data may be recorded but will not be disclosed to third parties except as permitted by the Privacy Policy or required by law.

6.2. Marketing:

  • By registering, you consent to receive updates, promotions, and occasional third-party offers via email or phone.
  • To opt out, email support@dontab.com with “unsubscribe” in the subject line or adjust settings in your profile.

6.3. Verification (New):

  • We may verify your Registration Details by contacting you via the provided phone number. Calls may be recorded for quality assurance.

7. Referral and Affiliate Program

7.1. Participation:

  • Participation is at dontab’s discretion and subject to compliance with these Terms.
  • dontab will honor agreed rewards if all conditions are met.

7.2. Fraud Prevention:

  • Fraudulent activities (e.g., creating multiple accounts, using fake information, or deceptive practices) may result in withheld rewards, commission denial, or program termination.
  • dontab may reject payments for failure to meet criteria or suspected fraud.

7.3. Changes:

  • dontab reserves the right to modify or terminate the referral and affiliate program without notice.

8. Limitation of Liability

8.1. General Exclusions:

  • The Platform is provided “as is” without warranties of accuracy, availability, or fitness for purpose.
  • dontab is not liable for:
    • Consequential, indirect, or special losses (e.g., loss of profit, revenue, data, or reputation).
    • Issues arising from third-party services, Listings, or linked websites.
    • Interruptions due to force majeure, technical failures, or operational decisions.
    • Viruses or harmful code, though we take reasonable steps to prevent them.
  • Users bear the risk of relying on Platform Content or transacting with other Users.

8.2. Business Users:

  • Liability is capped at AED 20,000 or the amount paid for the disputed Paid Service, whichever is higher.

8.3. Personal Users:

  • Liability is limited to foreseeable losses caused by dontab’s breach of these Terms, excluding commercial losses.

8.4. Exceptions:

  • Nothing in these Terms limits liability for death or personal injury due to negligence or other liabilities that cannot be excluded by law.

9. Indemnity

You agree to indemnify and hold harmless dontab, its affiliates, officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your misuse of the Platform.
  • Your breach of these Terms.
  • Your violation of third-party rights, including Intellectual Property Rights or privacy.

This obligation survives termination of these Terms.

10. No Spam Policy

10.1. Sending unsolicited emails, advertisements, or communications via the Platform is prohibited.

10.2. dontab may monitor communications to detect spam or scams, using automated or human methods.

10.3. Unauthorized use of dontab’s systems violates these Terms and UAE Cybercrimes laws, potentially leading to civil or criminal penalties, including imprisonment. We may report violations to authorities.

11. Acceptable Use Policy

All User Content and interactions must:

  • Be accurate, lawful, and non-infringing.
  • Not be defamatory, obscene, offensive, or harmful.
  • Not promote illegal activities, discrimination, or harassment.
  • Comply with UAE laws and regulations.

You are liable for any breach of this policy and must indemnify dontab for resulting losses.

12. Reviews and Ratings (New)

12.1. Users may post reviews or ratings of interactions with other Users to promote trust and transparency.

12.2. Reviews must:

  • Be factual, accurate, and based on genuine experiences.
  • Not be defamatory, malicious, or inflammatory.
  • Comply with the Acceptable Use Policy.

12.3. dontab is not responsible for Reviews and does not endorse them. We may remove Reviews that violate these Terms.

13. General Provisions

13.1. Governing Law and Jurisdiction:

  • These Terms are governed by the laws of the Dubai International Financial Centre (DIFC).
  • Disputes will be resolved exclusively in DIFC courts, except dontab may enforce Intellectual Property Rights in any jurisdiction.

13.2. Entire Agreement:

  • These Terms, the Privacy Policy, and any incorporated documents constitute the entire agreement between you and dontab, superseding prior representations unless fraudulent.

13.3. Assignment:

  • dontab may assign its rights and obligations. You may not assign yours without our written consent.

13.4. Notices:

  • Notices may be sent via email to your registered address or support@dontab.com. Notices are deemed received 24 hours after sending.

13.5. Force Majeure:

  • dontab is not liable for delays or failures due to events beyond our control (e.g., acts of God, technical outages).

13.6. Severability:

  • If any provision is found invalid, the remaining provisions remain in effect.

13.7. No Waiver:

  • Delay in enforcing rights does not waive them.

13.8. Language:

  • The English version of these Terms prevails in case of discrepancies with translations.

13.9. Third-Party Rights:

  • No third party has rights under these Terms.

13.10. Contact:
